In order to standardize the planning, construction, and operation management of fuel cell vehicle hydrogen refueling stations in the Lingang Special Area, and promote the healthy development of the industry, the “Regulations on the Construction and Operation of Fuel Cell Vehicle Hydrogen Refueling Stations in the Lingang Special Area (Trial)” were compiled and issued.

Purpose and overview
To standardize the construction and operation management of fuel cell vehicle hydrogen refueling stations in the Lingang Special Area, these measures were formulated in accordance with the principles of ensuring safety, unified planning, orderly construction, and standardized operations; and are guided by relevant laws, regulations and technical standards.

Definition
The fuel cell vehicle hydrogen refueling station (hereinafter referred to as the “hydrogen refueling station”) mentioned in these Measures refers to the special place and related facilities where hydrogen fuel cell vehicles are filled with vehicle hydrogen fuel.

Scope
These Measures are applicable to the planning, approval, design, construction, and acceptance of hydrogen refueling station construction in Lingang Special Area.
The work not specified in these Measures shall be handled in accordance with the relevant regulations of Shanghai Municipality.

Construction Land
Encourage the intensive use of land for hydrogen refueling station construction. Under the premise of complying with the special plan for the layout of hydrogen refueling stations in the special area, support legally constructed automobile refueling stations and gas refueling stations to use existing land to construct hydrogen refueling stations. In bus stations, airport ports, logistics parks and industrial parks, enterprises, it is possible to build hydrogen refueling stations on self-owned land such as transportation facilities and go through relevant procedures in accordance with the law.

The land for the newly added hydrogen stations will be supplied through public bidding, auction, and listing. The land for relocation of the hydrogen refueling stations can be approved by the economic and information departments to clarify the transferee, and the land will be provided by directional listing.

Project Flow
Newly built, rebuilt, and expanded hydrogen refueling station projects shall be submitted for approval in accordance with the approval procedures for construction in the special area.

Site Construction
The construction of hydrogen refueling station projects shall comply with relevant national and municipal standards and regulations. After the completion of construction of the hydrogen refueling station, the construction unit shall organize the completion acceptance according to the law, and it shall not be delivered to use if it has not accepted or failed the acceptance.
Design and Construction
According to different types, hydrogen refueling stations should be designed and constructed in strict accordance with GB 50156-2021 “Technical Standards for Automobile Refueling and Gas Refueling Stations” or GB 50516-2010 (2021 Edition) “Technical Specifications for Hydrogen Refueling Stations”. The design, construction, and supervision units of hydrogen refueling stations shall hold the corresponding qualifications. The units engaged in the design and installation of special equipment such as pressure vessels and pressure pipelines shall hold the corresponding special equipment licenses.

Filling Management
The hydrogen refueling site shall obtain the Shanghai gas cylinder filling permit, which is valid for 4 years.

The hydrogen refueling station shall provide vehicle gas cylinder filling services for fuel-hydrogen battery vehicles in accordance with the “Technical Regulations for Gas Cylinder Safety” (TSG23). The quality of the hydrogen sold should meet the requirements of “Hydrogen Fuel for Proton Exchange Membrane Fuel Cell Vehicles” (GB/T37244).

The operation of hydrogen refueling stations shall comply with the requirements of the relevant regulations of Shanghai.

Safety Management
Enterprises operating hydrogen refueling sites shall establish and improve safety operation management institutions and management systems in accordance with the requirements of the “Regulations for the Safety Management of Hydrogen Vehicle Hydrogenation Facilities” (GB/Z 34541).

The main person in charge of the company is the person in charge of safety, responsible for organizing the formulation and implementation of the company’s safety production regulations and operating procedures and is responsible for the safety of the company.

The safety management system shall include but not limited to the operation site safety management system, the fire safety management system, the equipment safety management system, the staff safety management system, the safety inspection management system, the accident reporting and handling process, the regular inspection system, and the safety and security work management system.

Hydrogen refueling stations shall, in accordance with regulations, inspect and register the operating certificates and inspection and evaluation information of the delivery vehicles that arrive at the station for unloading hydrogen, and the qualification certificates of drivers. They shall not accept unqualified vehicles for unloading. The hydrogen supplied by the hydrogen refueling station shall be regularly tested by a third party and the results shall be publicized.

The hydrogen refueling station shall organize a comprehensive investigation and treatment of hidden accidents on a regular basis, eliminate hidden accidents in time, and ensure safe production.

Hydrogen refueling stations should strengthen the safety training and education of employees and make provisions for personnel safety training and assessment.

The hydrogen refueling station shall equip employees with necessary safety protection equipment.

The hydrogen refueling station shall, in accordance with relevant national regulations and technical standards, set up corresponding safety facilities, equipment and devices such as fire protection, explosion protection, lightning protection, anti-static, monitoring, alarm, interlocking, etc., and conduct regular maintenance. Relevant records should be kept for more than three years.

The hydrogen refueling station should have a safety administrator on duty in each shift, responsible for supervising and inspecting the implementation of safety management measures, and correcting violations.

The safety management system and safety operation specifications of the hydrogen refueling station should be posted in a conspicuous position, and the hydrogen hazard risk notification board should be publicized to the general public.

Information supervision
The hydrogen refueling station shall establish a data acquisition and monitoring system for the station, and save the following data, of which the storage time limit of audio and video data is not less than three months; the storage time limit of non-audio and video data is not less than one year:
(1) Operation log of hydrogen equipment (operation parameters, maintenance records, inspection, and calibration records).
(2) Filling and refilling information.
(3) Security monitoring system data (parameters, audio, and video).
(4) Hydrogen quality records.
(5) Disposal records of hidden dangers and accidents.
(6) Emergency drill records.
(7) Personnel training records.
The collection of other data from hydrogen refueling stations shall comply with the regulatory requirements of relevant departments.
Security Assessment
The hydrogen refueling station shall hold a regular site safety evaluation report within the validity period and an annual safety evaluation report for daily operations.

Emergency Management
Hydrogen refueling stations shall strengthen emergency management in accordance with the relevant requirements of the “Management Measures for Emergency Plans for Production Safety Accidents” (Emergency Management Department Order No. 2):
(1) Prepare a comprehensive emergency plan, clarify emergency responsibilities, standardize emergency procedures, and refine safeguard measures; organize the review of the emergency plan and form a written review summary. The comprehensive emergency response plan shall be reported to the emergency management department of the jurisdiction for record.
(2) Formulate a dual prevention mechanism for the hierarchical management and control of safety risks and the investigation of hidden dangers, and report to the emergency management department of the jurisdiction for record.
(3) Organize an emergency plan drill every six months to evaluate the effectiveness of the drill, analyze existing problems, write an evaluation report, and propose amendments to the emergency plan.
(4) Organize the investigation of hidden dangers every six months and compile the investigation records.
(5) Equipped with necessary emergency rescue equipment, and carry out regular maintenance and maintenance to ensure normal operation.
(6) In the event of a safety accident at a hydrogen refueling station, emergency response should be initiated as soon as possible, and relevant forces should be organized for emergency handling and emergency rescue, and the accident information and emergency response activation should be reported to the emergency management department where the accident occurred in accordance with regulations.

Suspending Gas Supply If the gas supply needs to be suspended due to construction or facility maintenance, the hydrogen refueling station shall make an announcement three days before the suspension of the gas supply; if the gas supply is suspended for more than 24 hours or the gas supply is affected by an emergency, corresponding emergency safeguard measures shall be announced to the general public within 24 hours.

Effective Date
The Measures shall be implemented on a trial basis on January 1, 2022, and shall be valid for 2 years.

Automatic Invalidation
During the implementation of these Measures, if the administrative measures for the construction and operation of hydrogen refueling stations promulgated by the national and municipal competent departments are inconsistent with the relevant content of these measures, the relevant content will automatically become invalid on the day when the upper management measures are implemented.
